Understanding Maryland DUI And DWI Charges
Maryland Transportation Code § 21-902 prohibits driving under the influence of alcohol and driving while impaired by alcohol.
A blood alcohol content (BAC) of .08% or higher is considered driving under the influence per se. A BAC of at least .07% but below .08% is considered evidence of driving while impaired. Other evidence may also play a role in a DUI/DWI case.
For a first offense, DUI can carry up to one year in jail, a fine of up to $1,200 and 12 points on a Maryland driving record. A first DWI can carry up to two months in jail, a fine of up to $500 and eight points.
PBJ And Defending A First DUI/DWI Charge
Some people facing a first Maryland DUI/DWI offense may qualify for probation before judgment (PBJ). With a PBJ, the court stays the entry of a judgment of conviction and places the person on probation. A PBJ can also prevent DUI/DWI points from being assessed based on a conviction.
